What Is a Statement of Use?

A Statement of Use is a filing submitted to the USPTO confirming that your trademark is actually being used in commerce.

If your original application was filed on an intent-to-use basis, the USPTO requires a Statement of Use before your trademark can move to registration. This filing has to include proof showing how your mark is being used with your actual goods or services, not just a description of your plans.

When Is a Statement of Use Required?

A Statement of Use is required after the USPTO issues a Notice of Allowance on a trademark application filed on an intent-to-use basis.

If you applied before you started using the mark in commerce, the USPTO needs proof of actual use before registration is finalized. Filing a Statement of Use is how you provide that proof.

What Evidence Is Needed for a Statement of Use?

Your filing needs to include proof that your trademark is being used in commerce. This proof is called a specimen.

Statement of Use Deadlines and Fees

Once the USPTO issues your Notice of Allowance, your filing clock starts running.

Initial Filing Deadline: You generally have six months from the Notice of Allowance date to file your first Statement of Use.

Not in Use Yet? If your trademark isn’t in commercial use yet, you may need to file an extension request instead. Extensions carry their own additional USPTO filing fee.

Missing the Deadline: Skip both the Statement of Use and a valid extension request, and your trademark application can be abandoned.
