What This Free Trademark Search Tool Does (and Doesn't Do)
A free trademark search gives you a quick read on whether your brand name or slogan looks available. It’s a solid starting point if you’re planning to file a trademark application, but it isn’t the full picture.
What It Does
- Shows instant results for any existing matches to your search

Free Trademark Search FAQs
Searching your mark before you file helps you avoid an obvious conflict with an existing trademark and the nonrefundable filing fee that comes with it. It's also far easier to change course early than after you've spent years and real money building a brand around a name.
A federal database search alone doesn't guarantee superior rights to a mark. Someone may already be using something similar without ever registering it federally, which means your later USPTO registration could still be challenged based on their common law trademark rights.
Our federal search checks the USPTO database for direct matches, and marks that are phonetically similar, similar in meaning, or similar in appearance. Our federal, state, and common law search adds all 50 state databases, a business registry, and domain name records. Our global search adds WIPO, Canada, the European Community, and additional international databases on top of everything else.
A common law trademark exists automatically once you use a name, logo, or slogan in commerce, even without registering it. The catch is that common law rights are usually limited to the geographic area where you're actually using the mark. Federal registration extends that protection nationwide and gives you a stronger position if a dispute ever ends up in court.
No. We use commercially reasonable methods to flag marks that may match what you're planning to use, but there's no way to guarantee USPTO approval. Some conflicts, especially unregistered common law uses, aren't always caught by an automated trademark search.
Yes. Our free trademark search tool runs a basic check with no card required. You can also search directly through the USPTO's own Trademark Search System if you want to cross-check results yourself.
A basic free search returns results instantly, which works fine for a first pass. A full comprehensive trademark search usually takes a few days to complete.
Run a trademark search. A basic search shows direct name matches at the federal level. A comprehensive trademark search goes further and checks for marks that are only slightly similar but could still create confusion.
Cost depends mainly on how many classes of goods or services you're registering and which filing option you use. Trademark registration is billed per class, so more classes means a higher total cost. Intent to Use applications may carry an additional fee on top of the standard filing cost.
